Penalty APR and When it Applies |

(a) You may only earn cash rewards (“Rewards”) for Net Purchases on your Account. “Net Purchases” are determined by totaling all new Purchases charged to the Account during a billing cycle, then subtracting credits posted to the Account during the same billing cycle for returns, chargebacks, and/or other adjustments. We may round Net Purchases up or down to a whole dollar amount for purposes of determining and awarding Rewards. Rewards will not be earned for Advances (including wire transfers, traveler’s checks, money orders, foreign cash transactions, betting transactions, lottery tickets and ATM disbursements), Convenience Checks, Balance Transfers, INTEREST CHARGES and Fees, credit insurance charges, transactions to fund certain prepaid card products, U.S. Mint purchases, or transactions to purchase cash convertible transactions.
(b) You will earn a Reward of 3% on Net Purchases made at merchant locations that are classified in one of the following merchant category codes: Cellular, Gas and Office Supplies. All other eligible Net Purchases will earn a 1% Reward. We cannot control how merchants choose to classify their business and reserve the right to determine which Purchases qualify. As used herein,(i) the term ”Cellular” means cellular telephone equipment as well as cellular service; (ii) the term ”Office Supplies" means those goods and services offered for sale by a retailer designated with an Office Supply, Business Supply, Printing Supply or a Commercial Furniture merchant or industry code, established by the credit card associations and the merchant; and (iii) the term ”Gas” means and is limited to fuel dispensed for use in a motor vehicle designed for travel on public roads. Fuel dispensed at a warehouse club, superstore, supermarket or convenience store is not eligible for the 3% earn Reward and instead will earn at the 1% Reward. Purchases of gasoline in excess of $200 will not be deemed to be a purchase of automobile gasoline and as such will earn a Reward of 1%.
(c) Accounts that are eligible to earn Rewards are open, current and otherwise in good standing. Accounts are ineligible to earn Rewards when closed and/or after your enrollment in the Cash Rewards Program (the “Program”) is cancelled. At least the Minimum Amount Due must be received by the Payment Due Date or Rewards earned on the previous month’s Net Purchases will be forfeited. We, in our sole discretion, may disqualify you from participation in the Program and invalidate all Rewards for abuse, fraud or any violation of the Program.
The total amount of Rewards that may accumulate in a 12 month calendar cycle for your Account is unlimited. Rewards accumulated are non-expiring, subject to certain conditions set forth herein. Rewards you earn in a given billing cycle will be reflected on your Account Statement. Accrual of Rewards may begin on the date your Card and Cardmember Agreement are received by you. No retroactive Rewards will be given for prior purchases.
(d) Provided your Account is open, current and otherwise in good standing, an annual bonus equal to 25% of your prior year’s Rewards, up to a maximum of $250, will be awarded following your Rewards Enrollment Anniversary Date.
(e) Rewards may be redeemed subject to a $25 minimum and in additional increments of $25. Subject to Section (g) below, Rewards that are redeemed will be issued at your discretion in either the form of: (1) a deposit into a U.S. Bank Savings, Checking, or Money Market Account; (2) a U.S. Bank Rewards Card; or (3) a statement credit to your Account. The Account must be open, current and otherwise in good standing to be eligible to redeem the Reward. If your Account is closed for any reason or inactive for 18 consecutive months, or if you fail to make the minimum payment due by the payment due date for two consecutive billing periods, any Rewards remaining on your Account will be forfeited.
(f) We reserve the right to change or cancel the Program at any time, with or without notice to you. You are responsible for determining any tax liability arising from your participation in the Program. Consult a tax advisor concerning any tax consequences. Redemption of any Rewards does not affect your obligation to pay your Minimum Amount Due.
(g) The Business may request that Rewards be pooled to one Rewards balance at the Business level. The Business individual, who executed the application for credit, will have the sole authority to redeem the pooled Rewards. If the Rewards balance changes from pooled to individual, any unredeemed Rewards will stay pooled and will not transfer to the individual Rewards balance.
